Project Title: From Law to Justice – Sustainable Legal Aid System in Serbia

About the project: The overall objective of the project is to develop a sustainable system of free legal aid and improving the capacity of providers of free legal aidin Serbia.This will be achieved through: 1) strengthening the capacity of providers of free legal aid to a comprehensive and coordinated way provide legal assistance, and 2) creating a favorable environment for improving access to justice and the promotion and strengthening of the rule of law.

The Lawyers’ Committee for Human Rights (YUCOM), Autonomous Women’s Center and Regional Centre for Minorities express their deepest concern with the adoption and implementation of the Decree on the Measures of Social Inclusion of the Beneficiaries of Financial Social Support adopted by the Government of the Republic of Serbia. We believe that the Decree does not solve the issues of social isolation of the poorest and most vulnerable citizens of the Republic of Serbia and that some of the solutions prescribed are unlawful and unconstitutional.

Through a long-standing practice of providing legal aid assistance and other forms of activities aimed at upgrading human rights in Serbia, the Lawyers’ Committee for Human Rights – YUCOM has realized the significance of observing and studying corruptive behaviour and its influence on sustaining fundamental rights and the rule of law within society.

The House commenced its work thanks to the facilities provided by the City of Belgrade and the support for reconstruction offered by the Norwegian government. It was officially opened on Thursday by Crown Prince of Norway Haakon Magnus.

In October 2012, the Ministry of Justice and State Administration of the Republic of Serbia opened a public debate on the working version of the law amending and completing the Criminal code. In article 54a of this version, hate crime is defined for the first time: hate by reason of the victim’s racial, religious, national or ethnical belonging, sex, sexual orientation or sexual identity, as a motive to commit criminal offences is provided for as an aggravating circumstance in determining the sentence except where this circumstance does not characterize a criminal offence as provided for by law.

Representatives of the Humanitarian Law Fund, Belgrade Centre for Human Rights and YUCOM are attending seminars that aim to achieve the highest level of expertise in monitoring and reporting of the trial for war crimes before the Special War Crimes Department of the High Court in Belgrade. The trainings are organized by the OSCE Mission to Serbia and supported by the European Union.
