„Independent Judiciary and Freedom of Assembly as the Indicator of Chapter 23“

Lawyers’ Committee for Human Rights – YUCOM has the pleasure of inviting you to the conference „Independent Judiciary and Freedom of Assembly as the Indicator of Chapter 23“. The conference is organized with the support of the German Embassy within the project Effective Approach to the Justice in Serbia and will be held on Thursday, May 24, 2018 at 12 p.m. at the Human Rights House Hall, 4 Knez Milos Street.
The mplementation of measures within the Chapter 23 is of a great importance since it reflects the values, goals and principles that the European Union is built upon. Since the aforementioned Chapter has been opened for almost two years, grows the responsibility of civil society to monitor whether the implementation of the obligations of the State is also adequate. This time we would like to enphasise two topics that could be the indicators of inadequate implementation.
Commenting the court decisions and proceedings by the politians and officials still presents the the problem related to the conditions needed for the judicial inependence. At the conference YUCOM will present the report on the practice of commenting the court decisions by other branches of power which is contrary to the the implemented measure of adopting the special codexes in order to decrease the preasures on the judiciary by the aforementioned actors.
Chapter 23 includes the obligations of protection of basic human rights, so we want to start the discussion on the adequate protection of the freedom of assembly. The deterring effect of the adopted Law on Public Assembly to the possibility of excercising the right to free assembly show that there is a need for adopting the more adequate solutions within a new law that should also be more in accordance to the Constitution of the Republic of Serbia. The problems to be presented are detected through YUCOM’s practice.
